Drive distributor sued for ‘misleading’ movie trailer

A woman from Michigan has filed a lawsuit against FilmDistrict and theatre chain Emagine on the basis that the trailer for Nicolas Winding Refn’s Drive was misleading. Sarah Deming objected to the movie being promoted as similar to Fast and Furious and other driving movies when in fact it “bore very little similarity to a chase, or race action film… having very little driving in the motion picture.”

Many wouldn’t regard that as a negative point, as the majority of the movie’s reviews have been full of praise. The critically acclaimed thriller about a Hollywood stunt performer who moonlights as a getaway driver stars Ryan Gosling and Carey Mulligan and won the best director award at Cannes.

However, Deming claims the misleading marketing persuaded her to watch the film and she didn’t get what she paid for. She is seeking a refund for her ticket and an end to misleading movie trailers, and plans to turn her case into a class-action lawsuit. FilmDistrict has not publicly commented on the lawsuit, though Emagine has stated that it would be happy to refund the cost of the ticket bought by Ms Deming.
