- You agree to provide, under penalty of perjury, an accounting of all pages/URLs crawled and all data collected by any unauthorised Automated Data Collection means within ten (10) days of Flickering Myth’s request for such information.
- You agree to destroy any data collected upon Flickering Myth’s written request and that you will certify such destruction under penalty of perjury.
- By using any such technology on the site without prior written consent for any purpose except search engine indexing, you acknowledge that you are wilfully and flagrantly committing copyright infringement against Flickering Myth.
- You also accept and agree that by using any such technology on the site without prior written consent, for any purpose except search engine indexing, that you are entering into a legally binding contract with Flickering Myth Limited whereby you agree to pay a fee of £250 per individual URL crawled.
- Nothing herein shall be construed as preventing Flickering Myth Limited from pursuing any and all remedies available to it, including the recovery of monetary damages for – but not limited to – flagrant copyright infringement and breach of contract.
- You hereby indemnify us and undertake to keep us indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute) incurred or suffered by us arising out of any breach by you of any provision of these terms of use or arising out of any claim that you have breached any provision of these terms of use.
